Terms of Use for PAPHOS-PLACES.COM
1. Scope
1.1 These terms of use govern the use of Paphos-Places.com represented by DVYZR LTD, 8300 Paphos (hereinafter “Directory”) by natural persons and representatives of legal entities (hereinafter “Users”).
1.2 By using the directory, users expressly accept these terms of use.
1.3 For the posting of offers, services, events or company entries (hereinafter “information”) on Paphos-Places.com by commercial users, the General Terms and Conditions of Paphos-Places.com (hereinafter “paphos-places.com Terms and Conditions”) apply in addition to these Terms of Use, which can be accessed, printed out and/or saved via Paphos-Places.com.
2. Services
2.1 The directory offers users the opportunity to search for companies and retrieve information about them.
2.2 The information contained in the directory is provided by the respective companies. The provider assumes no liability for the accuracy, completeness or timeliness of this information.
2.3 The directory offers a selection of companies and services from Cyprus. The information presented serves as an overview and does not claim to be complete. Paphos-Places.com reserves the right to change or remove content at any time.
2.4 Paphos-places.com is entitled to change, add to, delete or discontinue parts of its services, Paphos-Places.com as a whole and/or individual functionalities at any time. Users do not need to be informed in advance.
This can happen, for example,
- to implement a court judgment and/or an administrative decision,
- in case of legal changes,
- to close security gaps or
- to expand or restrict the offer.
3. Registration and use
3.1 The registration and the use of the directory is generally free of charge.
3.2 Registration may be required for certain functions (e.g. creating your own company profile).
3.3 Users are obliged to provide truthful information when registering.
3.4 Users may only use the directory for lawful purposes. In particular, it is prohibited to use the directory to:
- to violate the rights of third parties,
- to spread viruses or other malicious software,
- Send spam or other unwanted content,
- to tamper with or disrupt the directory.
3.5 Registration for a customer account via the registration form represents an offer to open a customer account and conclude a user agreement. Registration only becomes effective after successful confirmation of the email address (double opt-in). Paphos-places.com reserves the right to reject the offer. Use of the customer account is free of charge and is based on these terms of use. Paphos-places.com may change or discontinue the functions and services offered at any time.
3.6 The security of access data is of utmost importance. Users are solely responsible for keeping their passwords confidential. Paphos-Places.com undertakes not to disclose passwords to third parties. To increase security, users should choose a secure password and change it regularly.
3.7 Paphos-Places.com is entitled to block access to customer accounts temporarily or permanently. This can happen if there are indications that a customer account is being used in a way
- which appears to be intended or likely to endanger the functioning of the services or
- who repeatedly violate the Terms of Use or
- to commit or promote criminal offences or
The decision on the sanction is made at the discretion of the court based on the severity of the relevant evidence and violations. Paphos-places.com is not obliged to inform users of a blocking. Information may be provided in order to give users the opportunity to comment.
3.8 Users can request that Paphos-Places.com delete their customer account at any time. This will terminate the associated user agreement with Paphos-Places.com. Users can send their deletion request by email to: delete@paphos-places.com.de. Deletion must always be requested from the email address with which users originally registered for the account.
3.9 Paphos-Places.com is entitled to terminate user agreements at any time by sending a corresponding notice in text form via email.
4. Contributions from users
4.1 The directory allows users to share their experiences with companies, events or products through text-based comments and a rating scale (hereinafter “ratings”) from one to five stars. One star represents the lowest rating and five stars the highest rating. These ratings are transparent and visible to all users and the rated companies. Providers can respond to these ratings with their own comments (hereinafter “comments”).
4.2 In order to submit a review, users must be able to prove that they were or are customers of the company being reviewed or that they actually use or have used the products being reviewed and have purchased them from the respective provider. Proof of purchase or attendance must also be provided for the review of events. Reviews may only be submitted by people who have personally used the events, products or services being reviewed. Owners, employees and family members of the company being reviewed and people who have received or been promised direct or indirect compensation for their review are not permitted to submit reviews. This includes discounts, vouchers, cash and non-cash benefits, loyalty points or bonuses.
4.3 Paphos-Places.com does not check whether reviews come from consumers who have actually used or purchased the reviewed product or service, unless the respective review is marked as a “verified review”.
4.4 Users are required to provide the customer or order number when rating a provider. This will then be forwarded to the provider. This gives the provider the opportunity to link the rating to the respective order process and to identify the user. The customer or order number will not be published within the rating. Providers can address their justified objections to ratings to: reviews@paphos-places.com.
4.5 Users are obliged to observe the legal provisions and these terms of use when submitting reviews. The same obligation applies to providers when submitting comments. Reviews and comments must be demonstrably true if they assert facts or contain a factual core. They must not contain insults or defamatory criticism, nor in any other way violate the rights of third parties. Paphos-Places.com reserves the right to demand proof of compliance with these requirements from users and providers.
4.6 Paphos-Places.com reserves the right to block or remove reviews and comments that violate the terms of use or separate review guidelines. Affected users will be informed of the deletion by email to the email address provided when submitting the review. Affected providers will also be informed of the deletion of their comment. Both users and providers have the opportunity to appeal against this decision.
4.7 If users frequently and obviously create unlawful reviews, Paphos-Places.com will suspend the use of the review service for these users or completely deny them the use of the directory. When deciding on the sanctions, Paphos-Places.com will take into account all known facts and circumstances.
4.8 By posting reviews, including text contributions, users grant Paphos-Places.com the non-exclusive, royalty-free and spatially and temporally unlimited right to use these online, offline, in all media and via all distribution channels. This also includes their
- Copy,
- making available to the public and reproduction
- Storage,
- Archiving,
- Provision to third parties and
- integration into other works.
This also includes the rights to edit and translate reviews. This only applies to the extent that the editing and redesign preserve the intellectual character of a work.
4.9 The above grant of rights entitles Paphos-Places.com in particular to publish reviews as part of the directory. Paphos-Places.com may also use reviews to advertise the directory, the products shown and the providers. Paphos-Places.com may also allow providers to use the reviews for advertising purposes. The scope and content of the granted rights of use are limited to what is appropriate for the operation and promotion of the Paphos-Places.com directory and the promotion of the rated products, events or providers.
4.10 There is no right to use the rating system or to publish ratings. Paphos-Places.com is entitled at any time to restrict the display of ratings that Paphos-Places.com considers irrelevant to users at its sole discretion. This particularly applies to ratings that are no longer current, refer to products that are no longer listed in the directory, or if the rated provider has changed its business name after the rating was submitted. Paphos-Places.com is also entitled at any time to change, add to and/or discontinue parts of the rating system or the entire system. An announcement is not necessary and usually does not take place.
5. Liability
5.1 The provider is only liable for damages that are based on an intentional or grossly negligent breach of duty by the provider or his vicarious agents.
5.2 Liability for minor negligence is excluded unless it involves a breach of a material contractual obligation.
5.3 Due to the volume of information to be processed, errors in the presentation cannot be ruled out. These can be based in particular on incorrect information from partners. Paphos-Places.com cannot therefore guarantee the accuracy, timeliness, completeness and quality of the information provided by partners. The provider assumes no liability for the availability of the directory or for disruptions in operation.
6. Contents
6.1 The user is solely responsible for the content he publishes in the directory.
6.2 The contents of this website are provided without guarantee of completeness, accuracy or timeliness. Historical data are for information purposes only and are not to be regarded as current. The user is responsible for checking the information.
6.3 The provider reserves the right to remove content that violates these terms of use or is unlawful.
7. Data protection
7.1 Personal data is handled in accordance with the provider’s privacy policy.
8. Changes to the Terms of Use
8.1 The provider reserves the right to change these terms of use at any time.
8.2 The user will be informed of changes to the terms of use by email or by a corresponding notice in the directory.
9. Note on dispute resolution
The European Commission provides a platform for dispute resolution (ODR platform) at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage. Paphos-Places.com is not obliged to participate in dispute resolution proceedings before consumer arbitration boards. Paphos-Places.com does not voluntarily offer users the opportunity to participate in such proceedings.
10. Final provisions
10.1 If any provision of these Terms of Use is invalid, the validity of the remaining provisions shall not be affected.
10.2 The law of the Republic of Cyprus applies.
